Do I need a cookie consent banner when using Microsoft Clarity on a US-focused website?
02:59 24 Aug 2026

I have a website whose traffic primarily comes from the United States, especially California, Florida, and Arizona.

I recently added Microsoft Clarity to the website for analytics/session recordings. I have also updated the website's Privacy Policy to disclose that Microsoft Clarity is being used.

I would like to understand the privacy/compliance implications of using Clarity in this situation.

My questions are:

  1. Do I need to add a cookie consent banner when using Microsoft Clarity for US visitors?

  2. Is updating the Privacy Policy to mention Clarity sufficient, or do I need any additional notice or consent mechanism?

  3. Are there any specific requirements I should consider for visitors from California, Florida, or Arizona?

  4. Does the requirement change if I use other analytics/marketing tools such as Google Analytics, Google Ads, or Meta Pixel?

  5. Are there any recommended configurations in Microsoft Clarity for handling privacy/consent requirements?

I'm primarily interested in requirements for US visitors, rather than GDPR requirements for European visitors.

Any practical guidance or references to the relevant regulations/documentation would be appreciated.
